Luke Gutteridge was taken to court after he accidentally dropped a piece of orange peel the size of a 10 pence coin..

The 29-year-old was spotted by an enforcement officer who accused him of littering and handed him a £75 fine. Luke had put the rest of the peel in the bin and swiftly picked up the small stray piece and apologised.

This turned into a 9 month legal battle in which the council lost.

That court accepted his defence that littering is only an offence if there is proof the person intended to leave it.

Luke's lawyer has aslo requested that his own fees - a further £4,000 are paid by central funds - which would also be public money.
